HC adjourns hearing on habeas corpus petition

Last Updated 04 May 2010, 19:23 IST

The petitioner, Manjula, wife of Narayanaswamy, had filed the petition seeking to produce her husband who has been detained in Parappana Agrahara Central Prisons. The petitioner has submitted that her husband, a resident of Chikkabegur village and a social worker, was arrested on false allegations on January 11, 2010.

Terming the allegation of the police as false, she submitted that the Court had already acquitted her husband in several cases. She submitted that though the High Court on April 15, 2010, had set aside the detention order terming it as unlawful, the police had not implemented the order.

When the petitioner again moved the High Court by filing a habeas corpus petition, the respondents withdrew an earlier order to detain the victim for 12 months of preventive custody and reduced it to three months.  The division bench comprising Justice Jawad Rahim and Justice Govindarajulu has adjourned the matter to May 6, 2010.
