The case had all the ingredients of a Bollywood thriller involving Dr Pradeep Gupta’s alleged rape of his hospital nurse, claims of blackmail, artificial insemination and surrogacy, ending in a settlment deed.
A Bench of Justices Altamas Kabir and H L Gokhale clarified that though rape was not a compoundable offence, yet, it was exercising its special powers under Article 142 in the interest of the welfare of the minor child born to the alleged victim.The apex court had on March 4 stayed the direction of the Chief Judicial Magistrate, Ghaziabad, for a DNA test on Dr Gupta, and the alleged victim’s son to establish the paternity.
The doctor had earlier claimed that the nurse had falsely implicated him in a rape case after becoming a surrogate mother through his sperm which were actually obtained for one Dilawar Singh.He claimed he had voluntarily donated his sperm to Dilawar Singh to enable him to have a surrogate child through the nurse who was working in his hospital.
