Allowing a State appeal, the Division Bench comprising Justice K Shridhar Rao and Justice Arali Nagaraj, sentenced Richard Rex Sukumar alias Avinash, resident of Murugesh Palya in Bangalore, for life imprisonment.

The court has also set aside the lower court order dated March 31, 2003 acquitting him from the charges of murder and has also directed the lower court to secure the accused and give effect of the order of High Court.

The Court has also sentenced the accused for one year imprisonment under Section 201 of IPC which amounts to destruction of evidence.

Background

The Wilson Garden police on May 31, 1996 had arrested Avinash in connection with the murder of Ziaull alias Masadiq, an auto consultant working with M K Rafeeq at Vishwas Agencies at Double Road circle, Bangalore.

Rafeeq had complained to the police on May 29, 1996 stating that his nephew Mohammed Ziaulla alias Mazadiq had gone missing along with a Maruti Car. He had stated that he went along with Avinash to show the vehicle and did not return.

The police had arrested Avinash who admitted that he murdered Ziaulla to get the car and dumped the body in a well at his house. The Wilson Garden police had challenged the lower court order which acquitted him.
