Lindsay Lohan avoids jail term with USD 300,000 bail

Earlier yesterday, Superior Court Judge Elden Fox had ordered Lohan, 24, be taken into custody without bail and scheduled Lohan's next court appearance for October 22. Lohan's attorney appealed against the ruling and LA County Superior Court Judge Patricia Schnegg said Lohan will be allowed to leave jail if she posts the bail.

Schnegg ruled that defendants in misdemeanour cases such as Lohan's are entitled to bail. But Schnegg imposed several conditions before allowing Lohan to post bail.
Lohan would be required to be fitted with an alcohol-monitoring bracelet within 24 hours of her release and refrain from drinking alcohol or possessing controlled substances.
Fox had earlier ordered that Lohan be taken into custody after she failed a court-ordered drug test. Instead of handing down a sentence against Lohan, Fox had ordered her jailed without bail until an October 22 hearing on whether she should be incarcerated for drug use.

Lohan's attorney Shawn Chapman Holley had called Fox's ruling legally incorrect because it involved a probation violation for a misdemeanour conviction. She then filed an appeal and judge Schnegg agreed that Lohan deserved bail.

"The case law is clear," Holley said. "She (Lohan) is entitled to bail."Lohan has twice been sentenced to jail, but in both instances she got out early because of overcrowding in the county's women's jail in Lynwood, the Los Angeles Times said.

Her return to jail came after her admission last week that she failed a court-mandated drug test. "Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before Judge Fox next week as a result," Lohan had written on her Twitter account last week.

The stint behind bars was Lohan's third round in jail for a three-year-old drug and driving under the influence of alcohol case filed in 2007.

Lohan left a rehab programme at UCLA Medical Center on August 24 after 23 days of treatment. Earlier in August, she was released from jail after serving just 13 days of a 90 day sentence for violating her probation.

At a hearing last month, Fox had ordered Lohan to go to weekly psychotherapy and behavioural therapy sessions, in addition to mandatory drug tests. Fox had said if Lohan violated the terms of her probation, she could go to jail again for 30 days.
