<p>Bengaluru: The Karnataka High Court has directed the state government to constitute a Commission of Inquiry in the police lathi charge against the protestors seeking reservation for Panchamasaali community on December 10, 2024 near Suvarna Soudha, Belagavi. </p><p>Justice M Nagaprasanna has passed this order in the petition filed by Sri Jagadguru Basava Jaymrutyunjay Swamiji and three others. </p><p>"The appointed Commission of Inquiry should be a single member or a multi-member headed by a retired Judge of this court. </p><p>"The Commission of Inquiry so appointed shall submit its report within three months of such appointment. The state shall place its decision on the Inquiry report before this Court in due course," the court said. </p> .Karnataka High Court upholds BDA acquisition of lands for two layouts.<p>The petitioners claimed that the police had indulged in lathi charge, without any prior notice, even though they were about 1.5 km away from the Suvarna Soudha. </p><p>On the other hand, the government advocate submitted that the lathi charge was the only option to maintain law and order. He added that the petitioners are not victims, but aggressors.</p> .<p>Justice Nagaprasanna noted that it was not the case of the state government that the petitioners were holding any arms. </p><p>" The inquiry is to be conducted, but by whom is the question. It cannot be by any State agency, as the Police Officers of the State themselves are alleged of assaulting the petitioners in the incident of the day. </p><p>"Therefore, in the considered view, the entire fulcrum of the lis becomes a classic illustration where a appointment of a commission of inquiry, one man or a multi member, under the Commission of Inquiry Act, 1952, need to be constituted for enquiring into the allegations of the incident of the day," the court said</p>
