ED challenges closure report in MUDA case involving Karnataka CM Siddaramaiah

Bengaluru: The Enforcement Directorate (ED) has moved a protest petition requesting the special court for elected representatives to not accept the B summary report (closure report) by the Lokayukta police in the MUDA alternative sites allotment case against Chief Siddaramaiah, his wife BM Parvathy and others. The protest petition stated that the Lokayukta police have not considered the vital evidence/information shared by the ED.

In February 2025, the Lokayukta police had filed B summary report against the accused Siddaramaiah, Parvathy, Mallikarjunaswamy, Devaraju and others in the case of alleged illegal allotment of 14 sites to Parvathy. In this case, the ED had registered the Enforcement Case Information Report (ECIR) on October 1, 2024.

The ED claimed to have the locus standi to file a protest petition since the ‘State’ comes under the definition of ‘victim’ of money laundering offence. Section 2(y) of BNSS (section 2 (wa) of CrPC) defines ‘victim’ as a person who has suffered any loss or injury caused by reason of the act or omission of the accused person and includes the guardian or legal heir of such victim.

In the protest petition, ED stated that the investigation revealed illegalities in the land acquisition, allotment, generation of proceeds of crime and routing/layering of the same undue influence in allotment. According to the ED, it shared the evidence/information with the Lokayukta police on November 30, 2024 and January 24, 2025.

The protest petition further stated that the evidence provided by it in respect to the illegalities, pertaining to the land at survey number 464 of Kesare village, were not considered by the Lokayukta police in the B summary report. The ED said the satellite images collected by it showed development works in the subject land, including asphalting of the roads, during the years 2001, 2002 and 2003. Hence, the contention of Devaraju and Malikarjunaswamy that they were not aware of the development work undertaken by the MUDA is not tenable as they could not have reached the land without using the roads asphalted by the MUDA, the ED said.

The protest petition said that though Malikarjunaswamy purchased the subject land in 2004, and gifted it to his sister Parvathy, till 2014 no compensation was claimed for 10 years. The Lokayukta police have not considered this aspect, the protest petition said. According to the ED, it also shared details about an individual, close to Siddaramaiah, who wielded undue influence in MUDA during the process of allotment of alternative sites. However, this aspect has not been considered by the Lokayukta police, the petition said.
