High Court notice to govt on export ban

V S Lad and Sons, Sesa Goa, Zeenus Transporter and K Praveenchandra have challenged the Government Order dated July 26 and 27, 2010 banning export of iron ore from the State.

The government has also ordered not to issue mineral dispatch permits to the exporters.
A Division Bench comprising Chief Justice J S Khehar and Justice Manjula Chellur directed the government to file its objections by August 16 and asked the petitioners to file their rejoinders by August 18 while adjourning the matter to August 20. When the matter came up for hearing, Justice Chellur recused from hearing from one of the petitions but continued to hear the rest.

The petitioners, exporters of iron ore,  have contended that the ban order is arbitrary, unconstitutional and without jurisdiction. Contending that export of mineral ore is their constitutional right, the petitioners have said that the ban did not serve any purpose and affects their livelihood.  They have sought to quash the impugned order.
