Lucknow court issues notice to Rahul Gandhi over remarks against Savarkar

The notice to Gandhi was issued by the court on a criminal revision plea challenging an order passed earlier in June dismissing the complaints against the Congress leader.

Congress leader Rahul Gandhi has been issued a notice by a sessions court in Uttar Pradesh's Lucknow district in relation to his alleged 'derogatory' remark made against V D Savarkar, Live Law reported.

The notice to Gandhi was issued by the court on a criminal revision plea challenging an order passed earlier in June dismissing the complaints against the Congress leader.

The court transferred the matter to Additional Sessions Judge/MP-MLA court, Lucknow noting that revisions were liable to be admitted given that it involved questioning fact and the law. The matter will next be heard on November 1, 2023.

Advocate Nripendra Pandey, who has currently filed the plea challenging the former order, had earlier moved the ACJM court seeking the registration of an FIR against Gandhi for his remarks on Savarkar.

Pandey in his plea has stated that by calling Savarkar a servant of the British and saying that he took a pension from the then-colonizers, the Congress leader was attempting to spread hatred in society.

"Kantiveer Damodar, the great leader of the nationalist ideology, was a fearless freedom fighter in the history of independence, who endured the inhuman atrocities of the British to free Mother India from their slavery and Gandhi insulted Savarkar ji using indecent words and made hateful utterances to spread inferiority complex towards Savarkar ji...," the plea stated as per Live Law.

Pandey stated that though Savarkar was described as a patriot by Mahatma Gandhi, Rahul through his statements was creating malice and social disharmony by propagating views which were unnecessary, due to which the complainant had to suffer a lot of physical and mental trauma.
