A bench headed by Justice B N Agrawal said: “As long as there is a candidate from the government quota available, no seat will be surrendered as vacant for the universities to fill up by their own candidate.”
In two rounds of hearing on the petitions filed by Yenepoya University and Medical Council of India (MCI), the court upheld the Karnataka High Court ruling and allowed the counselling of the students that concluded on Wednesday evening.
Karnataka government advocate Sanjay Hegde submitted that the state government would not surrender any seat to the private universities as they would auction them for higher prices at last moment. MCI advocate Maninder Singh submitted that the seats in these medical colleges could not exceed the allotted number of 100 for MBBS courses. Wednesday was the last day of counselling and admission for the MBBS courses in Mangalore-based Yenepoya and NITTE deemed universities.Yenepoya and NITTE deemed universities had refused to grant admission to 24 MBBS students.
