Rape accused gets bail in Delhi High Court as victim had tattoo of his name

The court also pointed out that it was not everybody’s job and it was also not the case of the victim that the petitioner had anything to do with the tattoo business

The Delhi High Court granted bail to a man, accused of repeatedly raping a married woman, as she had got his name tattooed on her forearm.

Justice Rajnish Bhatnagar allowed a plea for bail moved by Sanjay on Friday after noting his contention that the woman was in love with him.

Though the victim claimed the tattoo was forcefully engraved by the man when she was in captivity in his house from January 25, 2020, to April 15, 2020, the judge said: "In my opinion, making of tattoo is an art and special machine is required for it. Moreover, it is also not easy to make such a tattoo on the forearm of the complainant if there is some resistance from the other side."

The court also pointed out that it was not everybody’s job and it was also not the case of the victim that the petitioner had anything to do with the tattoo business.

It also relied upon the police charge sheet, which said the complainant herself had taken the house on rent and was residing there alone.

The man, who was in judicial custody since June 23, 2020, claimed that he was falsely implicated. He said it was a consensual relationship which is evident from the fact that the woman has got his name tattooed on her forearm, which showed her love for him.

The court also said at the time of arrest the mobile phone of the accused was seized, but no nude photographs were found, which according to the victim led to her sexual exploitation.
