HC dismisses petitions on delimitation of wards

The High Court of Karnataka has dismissed a batch of petitions seeking quashing of the notification issued by the state government with regard to reservation of wards in Shivamogga, Tumakuru and Mysuru municipal city corporations.

Justice B Veerappa dissmissed the petitions on the ground that the State Election Commission had already issued the calendar of events on August 2, 2018, and that the election process has already been set in motion.

The court observed that once the calendar of events has been issued, it cannot interfere in the election process in view of Article 243(O) of the Constitution of India

The court further observed, “It hopes that the government will take necessary steps to frame appropriate rules for reservation of wards with respect to the election of local bodies/ municipal corporations in accordance with Section 7(2) of the Karnataka Municipal Corporations Act.”
