Minister at Centre, Legislator in state

According to media-reports, Union Minister for Heavy Industries Vilasrao Deshmukh still has an eye on post of Maharashtra’s Chief Minister with his remark that even though he may be a Union Minister, yet he is still a member of state-assembly. It is beyond understanding why the simple reform of automatic termination of membership in state legislature after taking oath as Union Minister (and vice-versa) is not affected. It was the single controversial vote of the then Orissa Chief Minister Girdhar Gomango who misused his wrongly continued membership of Lok Sabha to pull down Vajpayee government to drag nation in costly mid-term elections.
 
Also, since a person cannot represent two constituencies at a time or become a member of both Parliament and state-legislature simultaneously, a person must not be allowed to contest from more than one constituency or for both Lok Sabha and state-assembly. Rather a sitting MP must resign from his/her seat before filing nomination for any other House, and vice-versa.
