In his petition, he has challenged the appointment of one man committee headed by Justice Padmaraj to probe into the allegations. “The allegation is against the Chief Minister himself and therefore he cannot appoint the judge,” the petition said.

The petition said that a complaint has been lodged with the Lokayukta, which is a constitutionally appointed body and cannot be bypassed by appointing another commission.

“This will end up being only financial burden, but will not achieve the goal,” the petitioner said.

Petition dismissed

The High Court has dismissed a petition by ITI Housing Co-operative Society (ITIHCS) challenging the denotification of the land allocated to them.

Hearing a petition by ITIHCS, which had challenged the denotification of land measuring 1 acre 22 guntas granted to them in September 2010, Justice D V Shylendrakumar dismissed the petition saying that the Government can take back the land if it has not given possession.

The petitioners had stated that the possession of the land has been given to them and cannot be denotified. They submitted that the Government has no power to do so after it had handed over the possession.

However the State submitted that it has not yet given possession of the land.
