The Supreme Court on Monday declined to entertain a petition challenging cricketer Sachin Tendulkar’s nomination to the Rajya Sabha. A vacation bench of Justices Deepak Verma and S J Mukhopadhaya questioned petitioner former MLA and journalist Ram Gopal Singh Sisodia as to why he did not approach the Delhi High Court with his plea.
Advocate R K Kapoor, appearing for the Delhi-based petitioner, submitted that the decision was in contravention of the Constitutional provisions, besides being violative of Article 14 (right to equality).
“Is the jurisdiction of the High Court taken away? Is the High Court not having power? We would not like to entertain the petition,” the bench said. The counsel, however, contended that he had a Constitutional right to approach either the Supreme Court or the High Courts.
