In a setback to the Gujarat government led by Narendra Modi, the High Court on Friday ruled that scholarships specific to minority communities is constitutionally valid. The verdict was arrived at by a five judge bench in a 3-2 decision.
Justice V M Sahai, Justice D H Vaghela and Justice Akil Kureshi ruled that the scheme was not violative of constitutional norms. Justice J B Pardiwala and Justice R R Tripathi, concurred with the state government’s contention.
The reference will now go to the division bench for a final order. The bench also ruled that the state government can be directed to implement the scheme.
