BJP accuses Congress of misusing CBI, NIA

The BJP has requested Prime Minister Manmohan Singh to constitute a commission of inquiry to probe the Congress misusing the CBI and the NIA to falsely implicate Gujarat chief minister Narendra Modi and other state officials in different cases.

BJP leader Arun Jaitley wrote an open letter to Prime Minister Manmohan Singh, saying that since the Congress cannot fight the BJP and Modi directly, they are resorting to different tactics to implicate Gujarat establishment.

“The CBI and the NIA have colluded with the politics of the Congress Party. The charges of politicization and motivated investigation should all be subjected to a Commission of Inquiry headed by a sitting of the Supreme Court,” Rajya Sabha leader of opposition wrote. 

The letter contains a critical synopsis of each of the three encounter cases Gujarat ministers and officials are facing, which he believes have been slapped with little evidence against them.

For instance, in Sohrabudin encounter case, Jaitley claims that despite CBI’s legal department conveying that there was no case against former Gujarat home minister Amit Shah, an officer of the agency observed in a “note” that he should be arrested “since it was necessary to reach the eventual target of investigation of Narendra Modi. This note was approved by the Director, CBI, Shri Ashwani Kumar”. 

Jaitley apprised the Prime Minister of the fact that Shah, who was eventually arrested and later released on bail on the basis of statements by two land grabbers of the state. 

Ramanbhai Patel and Dashrathbhai Patel were felicitated for having given such a deposition against Shah in a function presided over by Shankersinh Waghela, the then president of Gujarat Congress, he pointed out. Referring to the Tulsi Prajapati case, the BJP leader said that the only evidence mentioned against Shah, who is a close aide of Modi, by the CBI was that he was regularly in touch with the then IPS officer R K Pandian, an accused in the case.  The record shows that Pandian was regularly in telephonic contact of Shah much before and after the encounter as a part of his official duty since he was also heading the charge of SP, IB (Intelligence) of the State Police looking after political agitations and political activities.
