The government advocate filed an affidavit stating that the sub-inspector had not detained them and the two were called to the police station on May 13, regarding a civil dispute.
However, Kemperaiah who was present at court, disputed the submission stating that he was in police custody for a day and though not ill treated, had to live on biscuits and nothing else.
The Bench constituting Justices N K Patil and V Jagannathan took exception for filing a false affidavit and reminded that the salaries of government officials come from  tax payers’ money.  The police personnel have been directed to pay a compensation of Rs 5,000 each within ten days.

Bail granted

Two men who claimed to be merely witnesses to a double suicide in March 2009, were granted bail by the High Court on Thursday. Suleiman Sait and Harron Sait of Promenade road said that they had visited the residence of Noor Ulla Haq on March 1, to discuss business matters with Haq’s son Javed Akhtar and his wife Hazira Bano.
The couple were found shot in the bedroom of their house in Viveknagar off Banaswadi Main Road and died on way to hospital. Akhtar owned a travel agency on Bhagawan Mahaveer road.
Both the petitioners said their presence was incidental and they were not involved in the crime.
Justice V Jagannathan granted bail to both the petitioners.
