Appeal against Jaya's acquittal right step, says prosecutor

Special public prosecutor B V Acharya on Monday welcomed the State government’s decision to appeal against the Karnataka High Court order acquitting AIADMK chief J Jayalalitha in a disproportionate assets case.

Speaking to Deccan Herald, he said that the appeal is based on directions of a three judge bench of the Supreme Court, which has held that Karnataka is the prosecuting agency.

“There is nothing personal or political here. The Supreme Court’s three judge bench in its order pertaining to this case has held that the State of Karnataka is the sole prosecuting agency. Therefore, it has the responsibility to appeal. It has the legal obligation to take a legal opinion and appeal before the Supreme Court. It has taken a right decision now,” he said.

Acharya,who has been appointed by the State government as a special counsel to appear on behalf of the state in Supreme Court, said that he is collecting documents in connection with the case and will file an appeal immediately once he gets an official communication.
