DG&IGP appointment: Notice to govt, CM

The High Court on Wednesday ordered the issue of notices to the state government and the chief minister in a petition filed by Sushant Mahapatra, IPS officer and Director General of Police and Chairman, Karnataka State Police Housing and Infrastructure Development Corporation Limited, challenging the appointment of Omprakash as the Director General and Inspector General of Police (DG&IGP).

The petitioner said that government had issued guidelines and constituted a committee for selection of an officer as DG&IGP among the senior-most IPS officers of the state.

The government has neither consulted UPSC nor UPSC to shortlist or empanel the senior-most IPS officers for being appointed to the post. This aspect of the matter has not taken note of by the Central Administrative Tribunal (which has dismissed the petitioner’s plea). The petitioner the sought quashing of the CAT order. 

He has also challenged the constitutional validity of provisions of Police Act, 1963 and to declare it as unconstitutional.

He has also sought a stay on the government order appointing Omprakash as the DG&IGP.  A division bench comprising Justice Jayant Patel and Justice B Sreenivase Gowda adjourned hearing of the case to June 10.

Notice to ZP chiefs
The court on Wednesday ordered notice to all the presidents and vice-presidents of zilla panchayats of the 30 districts in the state in a batch of petitions challenging the reservations rotation of the elected candidates. 

The court had earlier refused to stay the elections for the post of president and vice-presidents as the election process had begun.  Justice Vineet Kothari ordered the issue of notices and adjourned the next hearing to July 25.
