SC declines disqualified MLAs' plea to attend U'khand House session

The Supreme Court on Wednesday declined to allow a plea by nine rebel Congress MLAs to participate in the Uttarakhand Assembly sessions which begin on Thursday.

But it clarified that if the motion for the removal of the Speaker was taken up anytime, it would be subject to the outcome of the proceedings against their disqualification.

A bench of Justices Dipak Misra and R F Nariman held that it does not “perceive any constitutional crisis” if such an order is passed. The court rejected a plea by the Speaker and others, represented by senior advocates Kapil Sibal, A M Singhvi and Rajeev Dhawan, that there was no requirement for any interim order.

The Harish Rawat government was reinstated after winning the floor test on May 10 on the order of the apex court. Buoyed by the Supreme Court judgement in the Arunachal Pradesh case, the rebels, including former chief minister Vijay Bahuguna, claimed that Speaker Govind Singh Kunjwal could not have started the disqualification proceedings against them a day after their notice for his removal on March 18.
