High Court stays students' college transfer circular

Syed Abdul Rehman and two others had challenged the order which said that the changes from first PUC to second year course would be allowed only when the parents of the students are transferred or change of residence following retirement of the parents.

The petitioners said that the order causes hardship to the students. They submitted that students seek change of college only when they realise that the institute they have joined cannot cater to their requirements or in case of poor infrastructure.

No authority

They had contended that the Director of PU Education has no authority to issue the circular, pointing out that a circular with similar intent issued on April 21, 2009 had been challenged before Circuit Bench of Dharwad and as such the matter is sub judice. The division bench comprising Justices Jawad Rahim and Justice Govindarajulu stayed the circular.
