HC notice to State, Centre over Right to Education

The petitioners, Karnataka State Minority Educational Institute Federation has moved the High Court stating that the Right to Education Act (RTE) does not apply to them as there is a State enactment in conformity with RTE Act.

The petitioners submitted that the State has already issued a circular on March 25, 2010 under Karnataka Education Act- 1983 much before the RTE Act came into force. The petitioners further submitted that the schools are under confusion regarding which Act to be followed.

The State’s circular has directed the schools to register under the State’s Act or face action. It has called for transparency in admission and has suggested several norms, fixed fees structure to be collected from the students, while the RTE is yet to come out with the rules. Justice B Srinivasagowda has ordered notice to the State and the Union Government and the matter has been posted after vacation.
