Justice Arali Nagaraj, in his order yesterday, also adjourned to August 25 the hearing of the criminal revision petition filed by the Bellary district election officer against them for questioning the orders of Bellary district court.

The state government, at a cabinet meeting last month, had decided to withdraw the cases of poll code violations against three BJP activists in Bellary, Somasekhara Reddy and Sriramulu.

The Election Commission moved the Bellary JMFC Court objecting the decision. After their petition was rejected by the court, the commission filed an appeal before the district court, which had passed an order on June 5, observing that the commission had no locus standi in the case until steps were initiated by the government to withdraw the criminal cases.

The cases relate to alleged violation of the model code of conduct during the 2008 Assembly elections.
