Lawyer wife files case against adv hus for triple talaq

A Muslim wife got a police case registered in Punjab’s Mohali against her husband after the latter attempted to get rid of her by calling out ‘Talaq’ three times following a dispute.

The wife, who has a master’s degree in law from Panjab University in Chandigarh, retorted saying the ‘triple talaq’ format was no more applicable to seek a divorce.

The husband, V Khan, a practising lawyer at the Nahan Court in Himachal Pradesh, now faces action under sections 406 and 498 of the IPC, the police said.

The couple got married in 2015 as per Muslim rituals. The wife says she was promised that after marriage she would be allowed to work as a practising lawyer along with her husband in the Nahan court where her husband was an advocate. That did not happen.

The complainant says she was asked to sit at home and perform household chores instead of contributing as an advocate, which she always wanted.

The complaint accused Khan of harassment and seeking dowry. She said the other day her husband called out Talaq three-time declaring that he now has no relationship with her.

While section 406 of the IPC deals with punishment for criminal breach of trust, section 498 deals with issues including matrimonial cruelty etc were charged.
