The Supreme Court on Tuesday declined to hear a plea seeking judicial enquiry by a retired Chief Justice of India into the incidents of stone pelting, clashes and "bulldozer justice" witnessed during the Ram Navami and Hanuman Jayanti celebrations in several states across the country.
"What kind of prayer is this, you want a judicial inquiry by a former CJI? Sorry, such a relief cannot be granted. We dismiss your plea," a bench presided over by Justice L Nageswara Rao told petitioner-advocate Vishal Tiwari.
The petitioner, for his part, contended that it was an alarming issue.
The bench, also comprising Justice B R Gavai, however, said no one was free to conduct such an inquiry.
Besides seeking judicial inquiry into communal violence, the petitioner also questioned the legality of "bulldozer justice" carried out by states of Madhya Pradesh, Delhi and Gujarat, saying it was discriminatory, and perpetrated on individuals not proved guilty by any court.
Such a deterrent punishment was against the notion of a democracy, governed by the rule of law, he said.
