HC breather for BSY, kin in four cases

Hearing a petition by Sohan Kumar challenging the lower court order, Justice K N Keshavanarayana ordered the issue of notice to advocate Sirajin Basha and stayed the proceedings against Kumar.

With the stay order in force, all further proceedings on the private complaint filed by Sirajin Basha, including the latest order by the special court directing the Lokayukta police to enquire and submit a report, will remain at status quo till further orders by the High Court.
 The stay order will halt all the proceedings in the lower court which is recording statements in the other complaints filed by Sirajin Basha and K N Balraj.

Five complaints

The two advocates filed five complaints before the Special Lokayukta Court for prosecuting Yeddyurappa, Sohan Kumar and others in January after Governor H R Bhardwaj accorded sanction for prosecution.

Accordingly, five complaints were filed in which 15 alleged offences committed by Chief Minister B S Yeddyurappa and his family members were mentioned.

During the hearing, former advocate-general and senior counsel B V Acharya argued: “There is total non-application of mind and material irregularity in taking cognisance in respect of the offences alleged against the petitioner herein.”

It could be recalled that on March 29, the High Court had stayed proceedings in the first complaint lodged by Sirajin Basha.

The designated special Lokayukta court on March 24 had handed over the probe to the Lokayukta police and had directed them to submit a report within six weeks.
