State to set up special children's courts

A special court will be created to try offences against children exclusively for Bangalore city, while existing district and sessions courts in other districts will be designated special courts for the purpose.

It was necessitated following a High Court direction to the State government in response to a public interest litigation by Maya C P, seeking direction to the State  to set up children’s courts as required under Sections 25 and 26 of the Commission for Protection of Child Rights Act, 2005.

Concurrence
The Chief Justice of the H C has given his concurrence for specifying the district and sessions court as children’s courts and also for establishing a special court in Bangalore city and to create one more post in the cadre of district judge to preside over the said court.

Pending examination of detailed proposals regarding sanctioning of various categories of posts and other infrastructure facilities, the Women and Child Development Department has been asked to issue necessary orders in this regard, as it has been agreed in principle for the establishment of children’s courts.

Order issued
As per the order issued by the Secretariat of Law, Justice and Human Rights, the principal district and sessions courts have been specified as children courts in the districts of Bangalore Rural, Belgaum, Bellary, Bidar, Bijapur, Chikmagalur, Chitradurga, Davangere, Dharwad, Gulbarga, Hassan, Dakshina Kannada, Kolar, Mandya, Mysore, Raichur, Shimoga and Tumkur.

The district and sessions courts have been designated as children courts in the districts of Bagalkot, Chamarajanagar, Chikkaballapur, Gadag, Haveri, Uttara Kannada, Kodagu, Koppal, Ramanagar, Udupi, and Yadgir. A separate children’s court will be created for Bangalore Urban district in Bangalore city.
