File affidavit, HC directs SP

Hearing a habeas corpus petition that 39 persons arrested during the riots were still housed in the jail, the division bench headed by Justice Manjula Chellur has directed the prison authorities to place all the records along with an explanation for their detention.
The bench sought to know why the arrested, brought to Mysore on August 6 following the HC order of August 3, were taken into custody again without a showcause notice.

The bench directed the jail authorities to furnish details related to the offence, and any judiciary orders if any, in this connection. “ Otherwise the concerned authorities will state why they were taken,” the bench said. The bench has also directed the ACP, Narasimharaja division, Mysore and the investigating officer to be present before the Court on Friday in this connection.

It may be recalled that the High Court had set at liberty all those detained illegally by the State following the communal riots at Kyathamaranahalli in Mysore on July 2, 2009.
