Last Updated 19 August 2009, 18:02 IST

The petitioners, Ravindranath, Biradar and over a hundred others, had moved the Tribunal against the appointment following the notification dated December 24, 2007 by the KPSC.
They had questioned the appointment of some of the candidates who had obtained degrees from Universities like Alagappa University, Annamalai University, Bharatidasan University, Madurai Kamaraj University and other distance education institutes.

They had stated that these universities do not have approval from Distance Education Council (DEC). However the bench ruled saying that the degrees conferred by the universities is valid and is not subjected to judicial review.

The bench said that under Section 22 of the University Grant Commission Act, the universities have the authority to confer the degrees and the tribunal cannot take them back.
