Special quota for Gurjars stayed

A division bench comprising Chief Justice Jagdish Bhalla and Justice Munish Nath Bhandari stayed the 5 per cent and 14 per cent reservation given by the state government to Gurjars and economically backward classes respectively, in an order issued here on Tuesday.

The stay comes in the wake of a letter petition filed by some students led by one G  Sharma alleging that the state government’s decision violated constitutional provisions.

The division bench observed that in the light of the Supreme Court order in Indira Sahni case, the government’s decision exceeded the 50 per cent limit. As such, the reservation to Gurjars and other economically weaker classes was not in consonance with the settled legal provisions.While issuing a show cause notice to the chief secretary  while marking a copy to the advocate general, the court restrained the state government from providing reservation that breaches the fixed limit.
