Probe prosecutor-accused link in 2G case: NGO

NGO Centre for Public Interest Litigation (CPIL) on Tuesday approached the Supreme Court seeking registration of an FIR on alleged nexus between prosecution and accused during trial in the 2G spectrum scam involving   corporate bigwigs and DMK leaders.

CPIL brought on record “certain disturbing developments” as a recent sting operation by a news channel purportedly showed CBI prosecutor A K Singh discussing legal strategy with Unitech MD Sanjay Chandra, an accused in the case.

“Unfortunately, most of the prosecution case had been conducted by the government-appointed CBI’s prosecutor A K Singh. It was Singh who had to face a battery of top lawyers appearing for the powerful politicians and corporates. It is precisely because of this reason, that the recent revelations are even more disturbing,” an application filed by the NGO said.

The plea made by advocate Prashant Bhushan wanted registration of FIR in the matter. Besides, it sought a direction to the Central Vigilance Commission to examine the record of trial court, including examination of prosecution witnesses to find out how much the prosecution case has been compromised by “this complete subversion of the process because of prosecution’s nexus with key corporate accused.”

Quick action sought

The NGO urged the apex court to direct immediate registration of the FIR as the CBI had so far registered only the preliminary enquiry into the matter.

It said that CBI must be directed to send the tape of the conversation for verification and voice-tests to multiple labs, including the Truth Lab, Hyderabad.

Bhushan also sought direction to the Centre to appoint a team of public prosecutors after selection by apex court. Senior advocate U U Lalit was appointed by the apex court as special public prosecutor in the case.

Former Telecom Minister A Raja, DMK MP Kanimozhi, three firms – Reliance Telecom, Unitech Wireless and Swan Telecom—are among 17 accused facing trial in the special court in the 2G case.
