Erin Brockovich-Ellis slapped husband before arrest

Environmental activist Erin Brokovich-Ellis reportedly had a fight with her husband and was seen throwing a cell phone in the river before being arrested for drunkenly driving her boat on a Nevada lake.

In a 16-page boating crime report, Nevada Department of Wild Life official Game Warden Kasen Haslem said that he was alerted about the argument taking place aboard a parked vessel at a Las Vegas boat harbor on June 7, E! News reported.

The employee told him that "both individuals appeared to have been drinking heavily during the day" and that he then witnessed the woman later identified as Brockovich-Ellis throw a cell phone into the lake and "then approached her husband and it appeared that she slapped him. After this they both appeared to sit down and cease arguing," Haslem recalled.

Brokovich-Ellis, a former legal assistant who famously brought down a California power company accused of polluting a city's water supply, has been charged with one misdemeanor count of operating a boat while intoxicated.

As a first-time offender in the state of Nevada, Brockovich-Ellis is facing a maximum sentence of six months in jail, a USD 1,000 fine, 96 hours of community service and court-ordered alcohol/drug counseling.

Haslem, in the report, recalls approaching Brockovich- Ellis and when he questioned her she "was slurring her words, and she kept repeating what she was saying, and (he) detected the odor of an alcoholic beverage on her breath."

Brockovich-Ellis later issued an apology for her behavior, saying, "I take drunk driving very seriously, this was clearly a big mistake, I know better and I am very sorry."
A hearing is scheduled in the case for October 7 in Henderson Justice Court.
