Stay on order of child rights panel extended

The High Court on Monday extended the stay order on the summons issued to a school run by minorities for not implementing the Right to Education Act, by the State Commission for Protection of Child Rights (SCPCR).

Hearing a petition by GEAR International School, which had moved the High Court challenging the summons order issued by SCPCR, Justice Anand Byra Reddy extended the stay order. The SCPCR had issued summons to the school authorities following a complaint by parents of a child.

Contending that the school being a institution run by minorities, the petitioner had stated that as per the Supreme Court order, the RTE Act does not apply to them and the SCPCR cannot issue summons and conduct public hearing. Noting that the SCPCR can just conduct an investigation, the petitioners had sought quashing of the summons issued. Justice Reddy, on the previous occasion, had stayed the summons order and it has been extended now.
