State to amend master plan regulations

Changes to be in line with BDA affidavit to HC

The State government on Monday told the High Court that it would amend the Zoning Regulations of Bangalore (ZRB) of the Revised Master Plan-2015 (Amendment) Regulations-2014, as submitted by the Bangalore Development Authority (BDA) last year.

The Namma  Bengaluru  Foundation has challenged the amendments made by the government to the ZRB, stating that they are in violation of the affidavit submitted before the court earlier.

The petitioners have contended that the present amendments to the zonal regulations are against the Town and Country Planning Act and will lead to commercialisation of residential areas.

ZRB amendments

The ZRB amendments, notified on December 11, 2014, according to the petitioners, “were arbitrary and contrary to the affidavit filed by the BDA and previous orders of the court. The amendments will lead to utter chaos in the City. It will further strain our infrastructure and lead to major inconvenience to people in residential areas.”

Violation of affidavit

Citing an affidavit filed by the BDA on February 19, 2014, that it will not allow any commercial activity in residential areas, the petitioners contended that the amendments made by the BDA would be in violation of the affidavit.

The government submitted that it will amend the regulations as per the BDA affidavit dated February 19, 2014. The division bench comprising Chief justice D H Waghela and Justice Ram Mohan Reddy adjourned the matter after the counsel for the Department of Urban Development, submitted that the ZRB would be amended to bring it in line with the affidavit filed by BDA.

The court also directed the BBMP not to sanction any further plans on the basis of the amended regulations and not to issue commencement certificate in cases where
plans have already been sanctioned.
