High Court raps Bangalore University for defying order

Hearing a contempt petition by U N Kempaiah, the division bench comprising Justice V G Sabhahit and Justice A S Bopanna, directed the University to place the sealed cover submitted by the board of appointment to the University authority while selecting Kempaiah as the professor of Mechanical department.

The petitioner has stated that the university had disobeyed the single judge order dated February 24, 2010 directing it to declare within four weeks results of the interview for the post of Professor of Mechanical department.

Counsel for the petitioner Ravivarma Kumar said the university had not complied with the order of the single judge.

It had wilfully disobeyed the court order.

The interview was conducted for the post of the professor on February 27, 2008. But University had not declared the result even though the government had approved the selection process.

The university submitted that the board of appointment (BoA) was not in accordance with law and it was constituted against the section 53 of Karnataka Universities Act.

The Syndicate of Bangalore University on October 4, 2008 had raised objections to the appointment made by the BoA. The court has adjourned the matter.
