SC panel firm on Dinakaran shift

The Supreme Court collegium, looking into Karnataka Chief Justice P D Dinakaran’s case, has again recommended that he be shifted to Sikkim.

This leaves the Centre with no choice but to act upon the advice. The SC collegium, headed by Chief Justice S H Kapadia, also recommended that Uttarakhand Chief Justice J S Khehar replace Justice Dinakaran in Karnataka. Justice Khehar’s post in Uttarakhand High Court will now go to the current Sikkim Chief Justice, Barin Ghosh.

The apex court committee included Justices Altamas Kabir, R V Raveendran, Dalveer Bhandari and D K Jain. Its recommendations were the same as those suggested by the SC collegium headed by former Chief Justice of India, K G Balakrishnan, which were sent back by the Centre for reconsideration, as Prime Minister Manmohan Singh was against frequent transfers of chief justices. The present collegium, however, turned down the government’s request not to shift Justice Barin Ghosh from Sikkim.
