Trade licence mandatory to function in city: High Court

The high court has held that for a gas station to function within the limits of the city, it has to obtain a trade licence from the municipal corporation concerned.

The court was hearing a petition filed by a gas company challenging the order of closure of its LPG dispensing station named 'Total Gas Auto' issued by the BBMP for functioning without a trade licence.

Sipani Energy Limited, Total Gas Auto, located at T Mariyappa Road in Jayanagar, had filed the petition.

The court disposed of the petition while upholding the corporation's contention citing the provisions of Section 353 of the Karnataka Municipal Corporations Act 1976.

The petitioner contended that they do not need a licence to operate under the Petroleum Act.

However, the court stated that there is no requirement for a no objection certificate from the public, but the municipal corporation will have to consider any objections if raised by the public.
