B S Krishna Prasad of Mysore had filed a plea challenging the appointment of the Vice-Chancellor stating that it was not in accordance with the University Grants Commission regulations.

The petitioner said the Vice-Chancellor did not have a PhD in Sanskrit but only a master’s degree. The Division Bench comprising Chief Justice J S Khehar and Justice A S Bopanna observed that no clear qualifications had been prescribed for the post of VC and UGC guidelines were not mandatory in nature.

The Bench also observed that the VC’s post entailed discharging administration duties and not that of a lecturer. However, the Bench observed that the court could not interfere in the matter.
