Woman moves SC to restrain husband from giving talaq

A Muslim woman on Thursday approached the Supreme Court, asking to restrain her husband from divorcing her, in line with the apex court's judgement on August 17, 2017 in Shayara Bano case.

She sought registration of an FIR against him in accordance with the Ordinance declaring the 'triple talaq' a punishable offence.

In a writ petition filed through advocate M M Kashyap, the woman contended that her husband, after 10 years of marriage, had ousted her illegally from the matrimonial home and given her a legal notice on March 25, 29 and May 7, claiming to have snapped all matrimonial ties.

The counsel mentioned the matter before a bench of Justices Indira Banerjee and Sanjiv Khanna seeking urgent hearing.

The court questioned the petitioner as to why she did not approach the High Court. Her counsel responded that since the apex court had passed the judgement declaring 'triple talaq' as constitutional, she preferred to approach the top court.

The bench then agreed to hear the matter on Friday, May 17.

Delhi-based woman said she had tolerated the constant beating, harassment and physical and mental torture for not bringing Rs 5 lakh dowry and a car. She has two children, a nine-year-old son and a six-year-old daughter.
