Karnataka Crisis | Curtain falls on 'Nataka' as HDK loses Trust Vote

It was indeed a grand 'Nataka'. Ever since the 15 MLAs resigned from the camp of the coalition government, the air of Karnataka was heavy with the smell of an imminent defeat and the beginning of a new reign. The defection of those MLAs gave BJP a massive upper hand in an intricate game, whereas Congress and JD(S) were left to scamper for shelter, and protection from a looming threat. A floor test battle ensued, where HD Kumaraswamy led coalition government had to prove their majority. The task looked improbable right from the beginning, with the rebel MLAs refusing to budge and the BJP tightening its grip around the chaotic situation.

When the process of floor test began, the coalition government tried hard to stall the seemingly inevitable. They raised the issue of the whip, stating that they must be given the chance to ban its party members and thereby punish them for their treachery. Under the expert guidance of 'half-lawyer' Siddaramaiah, they challenged the Supreme Court order that stated that the rebel ministers could not be compelled to take part in Assembly proceedings. The order read, “We also make it clear that until further orders, the 15 Members of the Assembly, ought not to be compelled to participate in the proceedings of the ongoing session of the House and an option should be given to them that they can take part in the said proceedings or opt to remain out of the same.”

The process went on for days, and with time, the suspense grew. On Tuesday, the determined speaker K R Ramesh Kumar said that he would end it on the very same day, and soon it became apparent that the curtain would fall soon. In the end, the floor test took place, and BJP got 105 votes against 99 votes of the Congress-JD(S) coalition camp.

The coalition government fell after being in power for 14 months, and HD Kumaraswamy submitted his resignation to the Governor of Karnataka Vajubhai Vala, bringing an end to the whole fiasco.

. According to PTI reports,BJP president Amit Shah held consultation with party leaders amid indications that BS Yeddyurappa maybe its chief ministerial choice in Karnataka after the H D Kumaraswamy-led coalition government fell on Tuesday.

Asked about its choice for the top post in the state, a party leader said Yeddyurappa, who is seen as the spearhead behind the drive to topple the Congress-JD(S) government, is an "obvious" contender but added that the top brass, including Prime Minister Narendra Modi and Shah, will take a call on the matter.

. Speaker Ramesh Kumar wanted to meet the rebel MLAs by 11 a.m on Tuesday but the rebel MLAs have decided that they will take their time, and are ready to face legal battles if disqualified.

Reacting to the fall of the Congress-JD(S) coalition government in Karnataka, Mehbooba Mufti tweeted, "After all the paid-for lavish trips to influence Karnataka lawmakers in Mumbai, what can one make of the HD Kumaraswamy led Cong-JD(S) govt collapse? It’s a black day for democracy when a country that prides in being the world's largest democracy watches an elected govt crumble."

General Secretary of AICC in-charge of Karnataka, KC Venugopal tweeted, "BJP has carried out one of the biggest political subversion and hawala transaction to destabilize the coalition government in Karnataka. Video evidence of BJP leaders offering money to the defected MLAs for destabilising the coalition government.The Congress party and JD(S) fought in the floor of the house, Honourable Supreme Court as well as in the street to upheld the democratic morals and values.All MLAs who stood with the party and workers who fought for upholding political morality in the state deserve huge respect. Although BJP could get an upper hand in the legislative assembly in terms of the number of MLAs, the Congress-JD(S) had earned the moral victory."

. INC leader Siddaramaiah tweeted, "The BJP, which has won in terms of numbers and money, is morally defeated. We have lost our alliance government in numbers, but not morally. Now our house is clean."

He further said that those who have left the party will never be inducted back.

. Governor has accepted Kumaraswamy's resignation and has asked him to continue as caretaker CM till alternative arrangements are made.

. Considering the fast unfolding political developments and possible skirmishes between various political party workers in the next few days, the Bengaluru Police on Tuesday issued prohibitory orders across Bengaluru following alerts by the intelligence sleuths.

Aimed at maintaining law and order in Bengaluru and preventing any untoward incidents that could disrupt the prevailing situation, Bengaluru City Police Commissioner Alok Kumar invoked section 144 of the IPC and issued prohibitory orders for two-days from 23 July 6:00 pm to 25 July 6:00 pm.

. It's the end of the road for HDK, the coalition government got 99 votes, as against the opposition's 105. with that the coalition government fell short of 6 votes, prompting HDK to resign.

. Officials have started counting votes in favour of the current dispensation. These are voice votes.

Counting of votes against the confidence-motion will begin shortly.

. HDK accused that the BJP is involved in the vicious act of horse-trading. He said that even though the BJP alleged that he was involved in the IMA scam, his government brought back Mansoor Khan.

The Speaker ordered to begin the floor test. HDK said he is ready for the floor test. So the much-awaited floor test is going to begin soon.

. HD Kumaraswamy said that he was not going to run away and was ready for the floor test. He said that he was not concerned about the number of MLAs present. He said that the BJP has made baseless allegations against him. He pointed out that it was his Special Investigation team that brought back Masoor Khan, the man behind the IMA scam.

Questioning the rebel MLAs on their need to "run away to Mumbai", he asked "what injustice the government has done to them".

"Both of them are ministers in the State cabinet and we have issued a whip for them to come and vote for the coalition. Earlier in the day, water resources minister D K Shivakumar had indicated that the two MLAs were in the city. "They have kept them closeby. I am waiting for the MLAs here (in Vidhana Soudha). Let us see how they will vote against us," he said.

When Yeddyurappa had staked claim to form government, the governor had given his 15 days to prove majority. This was struck down by Supreme Court which gave them 24 hours to prove majority. They couldn't.

Now, BSY is claiming that BJP has majority while the coalition hasn't. I have grown tired of Yeddyurappa's allegations.

Horse-trading started on the day Governor gave them the opportunity to prove majority.

MLAs will speak till 4 pm and CM will respond for an hour, after which confidence motion will put to vote.

. BS Yeddyurappa pointed out that the Congress MLAs have stormed out of the well of the House and theCM and Dy CM have left. He said that Siddaramaiah was silent.

Siddaramaiah responded saying, "Let's finish the discussion and the floor test can be held tomorrow." He said that they will conduct the floor test at 8 p.m tomorrow.

. JD(S)MLA Shivalinge Gowda said, "Karnataka is waiting to see if the rebels will respect your (BJP) ruling."

He said that his party was not "power-hungry".

BJP members stated that Shaivalinge Gowda had spoken for three hours on the Friday session, and as to why he is speaking again.

Earlier Priyanka Kharge said that Dy CMDr. G. Parameshwara and MLA D K Shivakumar wanted to speak.

The Speaker said that it is a 'misfortune' that he is heading the proceedings.

Previously, the women MLAs of the coalition were requesting the Dy Speaker to adjourn the session for 'humanity'.

The Dy Speaker said that the situation demands him to stay.

. Former CM and BLP senior leader Jagadish Shettar says that there was no order from the Supreme Court to halt the Assembly proceedings.

. As the coalition MLAs raised from their seats, proceeded towards the Speaker, started to chant slogans and requests, the Speaker said, "When the House is not in order, nothing will go on record."

. The chief minister H D Kumaraswamy said that the circumstances of the situation has changed and that several (rebel) MLAs would like to speak.

He also said that they agreed to a floor test today.

Regarding the fake resignation letter, he said that his signature was forged in it. The letter was passed around to the coalition MLAs and to Siddaramaiah.

. The Speaker, clarifying the zero-traffic for the rebel MLAs issue, said that "Nobody issues instructions on zero-traffic," and that "even the Governor did not issue any instructions."

He pointed out that there are visuals of the bus which ferried the rebel MLAs stopping at traffic signals.

. The Speaker K R Ramesh Kumar said that he had taken advice from theAdvocate General of Karnataka, regarding the whip issue. He said he adjourned the session on Friday, stating that the floor test will take place on Monday.

He also said that the Supreme court has placed the responsibility of ADDL on his shoulders, and since the SC functions in its way, he would not comment on it.

. H D Revanna says that it is BJP who is delaying the floor test and not them.

. MLA JC Madhuswamy said in the House that the Congress MLAs should not speak ill about the Governor. He said that there is no point in delaying the floor test.

Speaker K R Ramesh says, "If you repeat this, consequences will be disastrous. Don't make me do it."

. The CMO informed the chief minister about a forged resignation letter of HDK, addressed to the Governor, according to reports. HDK's signature was forged in the letter.

. Addressing the MLAs who were chanting slogans, the Speaker K R Ramesh Kumar said that he would give time for everyone to speak and hear them all.

He said he will clarify the zero-traffic issue with the traffic police as well.

. The Chief Minister asks the opposition MLAs to be seated and that he would not speak until they settle down.

. According to a TV report, the JD(S)-Congress request the Speaker for more time for the floor test in order to "pacify the rebel MLAs." They reportedly said that, thoughthe MLAshave resigned, they still remain members and requested the Speaker to "at least ask them to come to the session."

. Karnataka Assembly Speaker K R Ramesh Kumar hits out at the Cong-JD(S) alliance for the delay in the floor test and threatens to quit.

. The Supreme Court will hear on Tuesday a fresh plea of two IndependentKarnatakaMLAs seeking holding of the floor test "forthwith" in the state Assembly on the trust motion moved by Chief Minister H D Kumaraswamy.

A bench headed by Chief Justice Ranjan Gogoi on Monday declined to hear during the day the plea by R Shankar and H Nagesh.

. According to reports, the traffic police have given clarification to the Speaker and also submitted evidence stating that while protection was given to the rebel MLAs, they were notgiven zero traffic clearance.

. Post the CM's meeting with the Assembly Speaker, the floor testmight be postponed further, according to TV reports.

Additionally, 15 MLAs, including Siddaramaiah, are yet to speak in the Assembly.

Congress leaders continue to speak on floor test debate, but HDK is yet to return the Assembly. He apparently went back to his office in Vidhana Soudha.

. HD Kumaraswamy abstained from attending Assembly Session this afternoon and now, reports are coming in that Kumaraswamy has reached the Speaker's office in Vidhana Soudha.

. While resuming the floor test debate in Assembly, Speaker KR Ramesh Kumar said each member will get 10 minutes to speak on floor test debate.

"Don’t make me say this again and again," Kumar added.

. Soon after the Speaker adjourned the Assembly session, Congress leaders went to the KR Ramesh office requesting to allot more time for the floor test debate.

However, reports have indicated that the Speaker did not agree to therequest and mayplanto conclude the debate by 6:00 pm and hold the floor test.

. Krishna Byre Gowda alleged that R Ashoka behind MTB Nagaraj defying Congress party orders not to leave Bengaluru.

KBG showed a video-grab of MTB Nagaraj with R Ashoka in HAL Airport before leaving for Mumbai.

To this, BJP leader Madhuswamy countered it by accusing KBG and other Congress leaders of manhandling K Sudhakar in Vidhana Soudha after the latter submitted the resignation to the Speaker, earlier in the month.

. 2018: The Karnataka Assembly floor test was triggered by a fractured mandate in the state Assembly elections. The Supreme Court had given BJP leader BS Yeddyurappa 24 hours to prove his majority in the Karnataka Assembly.

BJP emerged the single largest party with 104 seats but fell short of crossing the halfway mark in the 222-member Assembly. The BJP was subsequently invited by the governor to form the government.

Yeddyurappa took oath as chief minister in the face of opposition from the JD(S) and the Congress party, who claimed they had the required numbers. The coalition came about after a hung verdict in the polls.

Yeddyurappa had to prove he had the support of more than 111 members on the House floor.

The BJP, despite being the single largest party, failed to reach the majority mark. HD Kumaraswamy, as the head of the coalition government of the Congress and the JD (S), won the trust vote in the Assembly with 116 votes.

2019: The coalition government in Karnataka became shakey after 16 MLAs - 13 of the Congress and three of the JD(S) - resigned from Assembly membership. Out of the 16, 10 MLAs' resignations were found to be not in the right format. The Supreme Court on Friday asked Speaker KR Ramesh Kumar to not take any decision on resignation or disqualification. However, Karnataka Chief Minister Kumaraswamy called for a floor test on July 12, 2019, to prove the government's majority in the Assembly. The Speaker allotted a slot on July 18 for the floor test.

The Supreme Court on Tuesday reserved its order for Wednesday at 10.30 a.m. on a plea made by as many as 15 rebel MLAs from Karnataka for a direction to the Speaker to decide on their resignations.

. After the entire process, if the result of votes cast by the present members is a tie, the Speaker steps in and casts his vote, thereby sealing the process.

. The legislators may change party without risk of disqualification in certain circumstances. One such is when a party decides to merge with or into another party. The law allows this provided that at least two-thirds of legislators are in favour of the merger.

In this situation, neither the members who decide to merge nor the ones who stay with the original party will face disqualification. The members' votes against their party directions will still be counted as valid.

However, cross-voting and abstaining from voting while they remain present in the Assembly would attract anti-defection provisions leading to disqualification.

When a member remains absent, unless he can prove that he was absent due to a genuine emergency, it would still attract action from the anti-defection law. To escape the anti-defection law, two-third of the members of a party must refrain from the above-mentioned disqualifications, i.e the members must defect.

. Article 102 of the Constitution lays down grounds for disqualification relating to the code of conduct and office of profit etc. Under Article 99 of the Constitution, no elected member of a House can take his or her seat before the oath of office is administered.

Under Article 104, they can be disqualified if they vote before taking such an oath. This means that a floor test cannot happen before the swearing-in of newly elected MLAs. Walking out of the House also calls for disqualification and becomes favourable to the opposing party.

The other major reason for disqualification is connected to either defection or switching of sides.

Anti-defection provisions were added to the Constitution as the Tenth Schedule after the 52nd Amendment. Anti-defection provisions are applied after a party has proven majority.

. The speaker would conduct the floor test. His main duty is to administer the oath to the newly elected members. The Speaker also looks into the resignations of the members of the House. The Speaker's role is also crucial during a confidence vote, with the disqualification of the MLAs, given India's anti-defection law. The Speaker, by convention, can exercise his vote in the event of a tie.

. Motion of no-confidence:

A motion of no confidence, alternatively the vote of no confidence or confidence motion - against the government in the state can only be introduced in the State Legislative Assembly. A State Legislative Assembly may be dissolved in a state of emergency, by the governor on request of the chief minister, or if a motion of no confidence is passed against the majority coalition.

A motion of no-confidence is usually moved by the Opposition when it feels that the ruling party or parties do not have a majority in the Assembly any longer.

Trust vote:

A trust vote can take place in an Assembly to give members the chance to convey confidence in a government. It is usually proposed by way of a motion of confidence moved by the government or brought by the Opposition. If the government lacks a majority, it would lead to its resignation.

A trust vote can be put into action when the ruling government resigns and another party stakes a claim to form the government.

. In a simple floor test or even in the case of a composite floor test, the majority is sealed based on the votes of the members present. The casting of votes can be done in two ways. Voice vote: The members cast their votes orally. Division vote: Votes are cast with the use of ballots, electronic gadgets or slips. In case of a ballot, the vote cast is a secret vote.

. A composite floor test is called for only when more than one party claims to form the government. This happens when the majority is not clear and the governor of the state calls for a special session to establish a majority.

. The speaker will conduct the floor test to ascertain the majority. The chief minister has to move a vote of confidence and win a majority. If the confidence motion fails, the chief minister has to resign.

. 1)What is a floor test? A constitutional mechanism devised to establish the executive i.e. the government's majority on the floor of the Legislative Assembly. The chief minister, appointed by the governor based on a party or coalition reaching a majority, is asked to move a vote of confidence when that majority is under question. The majority is then established or fails to be established through voting by members present in the Assembly on the designated day. If the chief minister fails to prove his majority, what follows is his resignation. A floor test can also be announced if there are differences between the parties in a coalition.

. Unwilling to go down without a fight, the Congress-JD(S) coalition is firm on issuing a whip to its legislators, mandating them to attend Chief Minister H D Kumaraswamy’s confidence motion proceedings today.

The interim order of the Supreme Court on the resignation of 15 Congress and JD(S) MLAs in Karnataka is ambiguous and can at best be described as a patch-work judgement aimed at tiding over the present political imbroglio, without addressing important constitutional questions that have arisen and could again arise in the future.

. The SC verdict could prove to be a huge setback for the ruling Congress-JDS coalition ahead of its confidence motion. The top court had said the 15 rebel MLAs can't be forced to attend the Assembly session, which means the HD Kumaraswamy regime will be short of the required number to prove majority. The coalition hoped to dangle the threat of disqualification by issuing a fresh whip. But now, the 15 MLAs will not be covered under the whip.

. Leader of the Opposition BS Yeddyurappa hailed the Supreme Court ruling and said Chief Minister HD Kumaraswamy will have to resign during the confidence motion on Thursday.

"This is a very good verdict. It's a victory for democracy. The whip won't apply to the 15 MLAs who have resigned. They can't be coerced into attending the Assembly session," Yeddyurappa told reporters. "That means Kumaraswamy has lost his mandate. SC asks Dhavan to read the reference made to arbitrariness in the Speaker's actions. But the counsel says mere reference is not good enough.

. Senior Advocate Rajeev Dhavan on behalf of Karnataka Chief Minister tells Supreme Court, "every MLA who went to Mumbai wants to be Minister. It is not an individual's case but a pack of 10 MLAs.It is a matter to be decided by evening."

"There is no case under writ jurisdiction. SC passed an order in excess of its jurisdiction.This is not between the Speaker and the court but between a CM and one who wants to be CM," Dhavan says.

. Singhvi on behalf of Speaker says, "You cannot take away my vested right by Article 32 petition. Disqualification is prior to resignation. Evil of defection is to be controlled. You may indicate the time limit. This is not an extreme case where you should intervene."

In this case, that has happened on July 11. 11 of the 15 MLAs handed over resignations personally to Speaker only on July 11. Four of the MLAs are yet to do so," he submitted before the SC.

. Singhvi says that it is factually wrong and Speaker has filed an affidavit to that effect that an appointment was not sought.

. "Large parts of what he (Rohatgi) saidis factually wrong. The point is that disqualification relates back to the original act.Timing is irrelevant. The whole exercise of date and speed is wrong equation.," Sr Ad AM Singhvi for the Speaker.

. "Date and race is irrelevant, Singhvi tells SC. It is not a race against time. This court is not to decide the existence or seriousness of disqualification," saidAbhishek Manu Singhvi

If the resignation is accepted I can join the next government and can continue for six months," says Rohtagi.

. 15 Rebel Congress and JD(S), who are now staying Rennaisance Hotel in Mumbai have apparently decided to skip the floor test at Vidhana Soudha, Bengaluru on July 18 - TV reports say.

It can be noted that the fate of the rebel legislators' resignation will be decided in the Supreme Court on July 16. Last week, they moved the top court against the Speaker KR Ramesh for delaying to decide their resignation.

. CM HD Kumaraswamy had asked the Speaker to hold floor test on Friday (19 July), to which main opposition BJP objected and requested to move the motion of confidence at the earliest.

. On Saturday (July 13), five rebel legislators --K Sudhakar, Roshan Baig, M T B Nagaraj, Muniratna and Anand Singh from Karnataka approached the Supreme Court seeking a direction to Assembly Speaker K R Ramesh Kumar to decide on their resignations.

They contended that the Speaker KR Ramesh is delaying to process the resignation and has failed in his duty.

“It is extremely pertinent to state that there were no disqualification proceedings against the said members as on the date of the resignation. Therefore, there is absolutely no ground to deny the said right of the resignation on the ground of pendency of disqualification proceedings. The said resignation cannot be invalidated by filing disqualification proceedings subsequently,” their plea states.

Supreme Court said they would hear the case of five rebel MLAs tomorrow along with the main petition which is pending before them.

A bench headed by Chief Justice Ranjan Gogoi is hearing a bunch of pleas moved by the speaker and the rebel Congress and JD(S) MLAs.

The MLAs told the bench that the speaker had not taken any decision on their decision to step down, adding that he had no immunity with regard to the acceptance of the resignations.

However, the counsel appearing for the Karnataka Assembly speaker said he was constitutionally obligated to decide on a plea for disqualification of the rebel MLAs.

The hearing is underway in the top court.

However we have all the respect to the judgement of SC and we will take the SC advice seriously. . In a surprising turn of events, 14 rebel Congress-JD(S) legislators from Karnataka - who were camping in Mumbai for last three days - have moved to Goa.

The MLAs have been staying in the Sofitel Hotel in Bandra-Kurla Complex.

Meanwhile, 10 MLAs are expected to arrive in Mumbai as the political crisis deepened in Karnataka.

Two senior BJP leaders including MLC Prasad Lad, who is the Maharashtra unit vice president and a close confidant of chief minister Devendra Fadnavis and Mumbai BJP Yuva Morcha president Mohit Bharatiya are in touch with the legislators.

On Saturday evening, 12 MLAs of Congress and JD(S) have checked into the Sofitel Hotel, while one reached on Sunday. Independent MLA H Nagesh reached on Monday.

According to sources, all the 14 have left for Goa and they are expected to be put up in a luxury resort away from public glare.

The crisis, which had been brewing ever since the BJP swept the parliamentary polls in the state, deepened as 13 Congress and JD(S) MLAs submitting their resignation to the speaker.

The Congress and the JD(S) managed to win just one seat each in the state having 28 Lok Sabha constituencies. The BJP bagged 25 seats and an Independent supported by it won from Mandya.

The wobbly coalition in power for 13 months has a strength of 118 in the 224-member assembly and faces the risk of losing majority if the resignations are accepted.

Stating that the resignation of MLAs is a "game plan" of Siddaramaiah, Joshi said, "The current political crisis is actually an outcome of power struggle between Siddaramaiah and Kumaraswamy."

On one side Siddaramaiah wants to destabilise the government and on the other, Congress leader DK Shivakumar is working to save it, the BJP lawmaker from Dharwad in Karnataka said.

Assembly Speaker Ramesh Kumar, who was not in his office when 12 of the rebel legislators of the coalition went there to put in their papers on Saturday, has said, "Whether the government will fall or survive" would be decided "in the assembly".

. The Congress on Saturday accused the BJP of trying to bring down its coalition government in Karnataka by "buying" MLAs and asserted that the new word for the 'aaya ram gaya ram' phenomenon is "MODI -- mischievously orchestrated defections in India".

The strong reaction of the party came after 13 legislators of the ruling Congress-JD(S) alliance in Karnataka submitted their resignation to the Speaker.

The ruling coalition, which has 118 members, faces the risk of losing the majority in the 224-member Assembly if the resignations are accepted.

"The new word for 'aaya ram gaya ram' is MODI -- mischievously orchestrated defections in India. The Karnataka government which is a joint government having complete majority under our democratic setup is now being sought to be pulled down by defections and resignations," Congress's chief spokesperson Randeep Surjewala told reporters here.

"MLAs are being bought in broad daylight. We deprecate the efforts of the BJP to buy over legislators, to pressurise legislators, to bring down an elected government in Karnataka," he said, asserting that the BJP has made such moves in other states in the past as well.

The 'aaya ram, gaya ram' phenomenon refers to the practice of MLAs defecting to other parties.

. Congress Legislature Party (CLP) leader Siddaramaiah on Tuesday said Prime Minister Narendra Modi and Union Home Minister Amit Shah were involved in the attempts to topple the Congress-JD(S) government in Karnataka.

. “If there'san election six months from now, the Congress is unlikely to win. If there’s an election two years later, we still don’t know. So, why not be in power as long as it lasts?”

This is how a top Congress leader summarizes the mood in the party, even as uncertainty looms large over the Congress-JD(S) coalition after the resignation of Congress legislators Anand Singh and Ramesh Jarkiholi.

The HD Kumaraswamy-led coalition government, which has completed 13 months in office, has had a sword hanging over its head since day one. “It’s been like this every day,” Congress’ Mines & Geology Minister Rajashekhar Patil told reporters.

For the Congress leadership, however, keeping the coalition intact is inevitable, much as some of its own leaders are against it - a true dilemma, as this alliance with the JD(S) is hurting the party on one hand and the need to stay in power on the other.

The party is putting up a brave face. Notwithstanding the looming crisis, Karnataka Pradesh Congress Committee (KPCC) president Dinesh Gundu Rao left for London with family.

Apparently, Congress is confident that when it comes to the numbers game. If Assembly Speaker KR Ramesh Kumar accepts the resignation of Singh and Ramesh, the strength of the Congress-JD(S) combine will be down to 117. The BJP has 105 and will need another 13 MLAs to resign to be able to form its government. “That’s a big number of people who should resign,” a Congress minister pointed out. “And it’s not easy.”

Water Resources Minister DK Shivakumar, the Congress’ Man Friday, said Tuesday there was no need to panic. “This government will complete its full term,” he said. “It’s not that we don’t know the games being played.”
