Consumers duped with false promises

T Priyadarshini, a consumer, had filled a contract form of A J Interlinks Pvt Ltd (Jayalakshmi Arcade) in Big Bazaar at Bapuji Nagar. Later, the representatives of the shop called her 20 times saying she had won a package of holiday in a five-star hotel and pestered her to collect her gift from them.

When she finally went there, she was conned into pay Rs 1,78,000 for which she was promised complementary plots measuring 1,200 feet at Anjaneya Garden near Chennai. She was told that her money would be refunded later. Besides, she was promised a five-week holiday package at any of AJ Interlink’s resorts in India for five years.

When she didn’t receive any document or the gifts they had promised, she sent a legal notice. As she didn’t receive any reply, she approached the Bangalore Urban 3rd Additional District Consumer Disputes Forum where President Justice T Rajashekhariah ordered the firm to repay the amount with interest at 12 per cent. 

In another case, Mageshwari E bought a sofa at Looking Good Furniture in Koramangala for Rs 40,000 in 2009. Though the shop had claimed that the sofa was made of Italian leather and promised one-year guarantee, within six months the sofa upholstery began to peel off. She complained to the shop which sought Rs 15,000 for repairs. To her shock, the shop also told her that the sofa was made of artificial synthetic leather and not of Italian leather as told to her at the time of purchase.  

She complained to the III Consumer Forum where the shop said there was no guarantee on the sofa as it was made of artificial China leather.

The Forum President ordered the shop to pay up Rs 40,000 for the deficient service within a month failing which it would have to pay interest at 12 per cent on the sum till the date of repayment to the consumer.

Club told to refund

The Forum has ordered Country Club (India) Ltd to refund Rs 1,60,000 to S N Narasimha Murthy, who became a member and was given three mysterious sites in Vedic Country Spa Project - 11 Kool. The Club did not mention where the sites were located and not even the boundary of these sites! They have been found guilty of deficient service by the court.
