The application came up for hearing today before the Principal Judge Swapna Joshi who adjourned it to May 7, when Hasan would be produced before her for extension of remand.
Patna police had yesterday approached the court here seeking Khan's custody. They presented a production warrant issued by the chief judicial magistrate of Patna as Khan is required in the passport forgery case of 1997 there.
Khan's counsel, I P Bagadia, however, objected to the plea saying the production warrant was addressed to the Arthur Road Jail and not to the court. Hence it should be returned.
However, the State, through Govind Patil, additional senior jailer of Arthur Road, then made an application saying that the sessions court in Mumbai could direct the jail authorities to send him to Patna, as Khan is in court's custody now.
Khan is in judicial custody till May 7 here. The court would also hear on May 4 his plea seeking medical assistance for injury to leg. He has pleaded that he is a diabetic and needs immediate treatment.
