High Court issues notice to MUDA

The petitioner Sulochana Balram Bhat had moved the High Court challenging the March 5, 2009 order of MUDA and Urban Development Department (UDD) seeking an undertaking. The petitioner owns over four acres of land at Kurubarahalli in Mysore Taluk. MUDA in 1997 had notified it for acquisition and delayed the process for over a five years. When the acquisition process began after five years, it was stalled by the petitioner by approaching the court.

However when the petitioner sought to change the land use, the respondents had denied the permission and had sought an undertaking from the petitioners stating that she would not apply for it. 

Justice B S Patil, who heard the matter has ordered notice to MUDA, UDD and DC Mysore.

Appointment quashed
The High Court has quashed the appointment of trustees to the Sri Mahalingeshwara Temple in Pervaje, Karkala Taluk. Hearing a petition filed by Prabhakar Bangera, Justice Ajith Gunjal had quashed the Udupi district commissioner order dated February 17, 2009 appointing Chandrashekara Suvarna and others as trustee to the temple.

 The Court in its observation said “ There is no application of mind while appointing trustee to the temple. The appointment has been made following the instructions of the home minister.”

The petitioner had submitted that the appointment was based on a letter by Sunil Kumar, former MLA of Karkala to home minister. Following this V S Acharya, Home Minister had directed the district commissioner to appoint Chandrashekara and others as trustee to the temple.
The petitioner had also produced the letter of the home minister to the court.
