HC stays BDA demolition

Srinath Hegde and 23 others had moved the High Court after the BDA began demolition of structures to recover the land. The BDA had stated that several illegal settlements had come up in the area.

The petitioners submitted that they had been residing in the locality for several years. The BDA had acquired the land on August 2, 1978.

However, the BDA could not form the layout within five years under Section 27 of the BDA Act.

They also contended that under Section 4 of the KMC Act, the area comes under the corporation and BDA had no authority to demolish property, unless a special notification was made under Section 29 of the  BDA Act.

Citing that the BDA cannot deprive them of their house, the petitioners sought directions to stop the demolition process. Justice B S Patil, who heard the matter has stayed the demolition.

On Tuesday, Deccan Herald had carried a story on sudden demolition drive which caused inconvenience to the Geddalahalli residents.
