<p>New Delhi: The Supreme Court has directed the authorities not to notify result upon recounting of votes to election of M K Pranesh, current deputy chairman of Karnataka Legislative Council, as an MLC in 2021 poll.</p> <p>Though the court allowed recounting of votes, it directed for furnishing the result in sealed cover before it.</p> <p>A bench of Justices Surya Kant and N Kotiswar Singh decided to examine a plea filed by Pranesh against the Karnataka High Court's order of January 29, 2025.</p> <p>BJP leader Pranesh led by senior advocates Maninder Singh, S Niranjan Reddy and Anand Sanjay M Nuli challenged the validity of the High Court's order, which directed for recounting of votes on a plea by unsuccessful Congress candidate A V Gayathri Shanthegowda and others.</p>.Sack Kokate, Munde from state cabinet, demands Maharashtra Congress chief.<p>Senior advocates Kapil Sibal, A M Singhvi, Venugopala Gowda and advocates Balaji Srinivasan and K V Muthu Kumar appeared for respondent unsuccessful candidates.</p> <p>The court issued notice to the respondents, seeking their response within one week and fixed the matter for consideration on March 4.</p> <p>"Meanwhile, recounting may take place, however, the result shall not be notified and the same be produced before us in a sealed cover," the bench ordered.</p> <p>The election of Pranesh to Chikkamagaluru Local Authorities Constituency, Karnataka -2021 was challenged before the High Court primarily on the ground that nominated councillors of the Town Panchayat are not entitled to vote in the elections to State Legislative Council.</p> <p>Relying upon a 2000 judgment, the petitioner contended election cannot be invalidated on the ground that ineligible voters (nominated members) have voted, so the recounting ought not to have been directed.</p> <p>His plea also stated the issue of whether ‘nominated persons’ are entitled to vote in the election to the Karnataka Legislative Council or not, is sub judice before this court. It also stated recounting cannot be ordered merely because the margin of win is small.</p> <p>Pranesh was elected as MLC in an election held on December 10, 2021 by a victory margin of six votes.</p>
