It was indeed a grand 'Nataka'. Ever since the 15 MLAs resigned from the camp of the coalition government, the air of Karnataka was heavy with the smell of an imminent defeat and the beginning of a new reign. The defection of those MLAs gave BJP a massive upper hand in an intricate game, whereas Congress and JD(S) were left to scamper for shelter, and protection from a looming threat. A floor test battle ensued, where HD Kumaraswamy led coalition government had to prove their majority. The task looked improbable right from the beginning, with the rebel MLAs refusing to budge and the BJP tightening its grip around the chaotic situation.
When the process of floor test began, the coalition government tried hard to stall the seemingly inevitable. They raised the issue of the whip, stating that they must be given the chance to ban its party members and thereby punish them for their treachery. Under the expert guidance of 'half-lawyer' Siddaramaiah, they challenged the Supreme Court order that stated that the rebel ministers could not be compelled to take part in Assembly proceedings. The order read, “We also make it clear that until further orders, the 15 Members of the Assembly, ought not to be compelled to participate in the proceedings of the ongoing session of the House and an option should be given to them that they can take part in the said proceedings or opt to remain out of the same.”
The process went on for days, and with time, the suspense grew. On Tuesday, the determined speaker K R Ramesh Kumar said that he would end it on the very same day, and soon it became apparent that the curtain would fall soon. In the end, the floor test took place, and BJP got 105 votes against 99 votes of the Congress-JD(S) coalition camp.
The coalition government fell after being in power for 14 months, and HD Kumaraswamy submitted his resignation to the Governor of Karnataka Vajubhai Vala, bringing an end to the whole fiasco.

According to PTI reports,BJP president Amit Shah held consultation with party leaders amid indications that BS Yeddyurappa maybe its chief ministerial choice in Karnataka after the H D Kumaraswamy-led coalition government fell on Tuesday.

Reacting to the fall of the Congress-JD(S) coalition government in Karnataka, Mehbooba Mufti tweeted, "After all the paid-for lavish trips to influence Karnataka lawmakers in Mumbai, what can one make of the HD Kumaraswamy led Cong-JD(S) govt collapse? It’s a black day for democracy when a country that prides in being the world's largest democracy watches an elected govt crumble."
General Secretary of AICC in-charge of Karnataka, KC Venugopal tweeted, "BJP has carried out one of the biggest political subversion and hawala transaction to destabilize the coalition government in Karnataka. INC leader Siddaramaiah tweeted, "The BJP, which has won in terms of numbers and money, is morally defeated. We have lost our alliance government in numbers, but not morally. Now our house is clean."
He further said that those who have left the party will never be inducted back.

Several Congress workers gathered outside Nitesh Wimbledon Park apartment complex in Seshadripuram, after learning that two MLAs R Shankar and H Nagesh were staying in one of the apartments.
Speaking to reporters outside the complex, MLC Ivan D'Souza said that they had come to the venue to wait for the MLAs to come out. Water Resources Minister D K Shivakumar on Tuesday said that he was extremely hurt by certain remarks of a section of BJP leaders and the way in which he was treated in Mumbai when he had gone there to meet rebel Congress legislators.

The Speaker, clarifying the zero-traffic for the rebel MLAs issue, said that "Nobody issues instructions on zero-traffic," and that "even the Governor did not issue any instructions."
He pointed out that there are visuals of the bus which ferried the rebel MLAs stopping at traffic signals.
The Speaker K R Ramesh Kumar said that he had taken advice from theAdvocate General of Karnataka, regarding the whip issue. He said he adjourned the session on Friday, stating that the floor test will take place on Monday.
He also said that the Supreme court has placed the responsibility of ADDL on his shoulders, and since the SC functions in its way, he would not comment on it.
H D Revanna says that it is BJP who is delaying the floor test and not them.
MLA JC Madhuswamy said in the House that the Congress MLAs should not speak ill about the Governor. He said that there is no point in delaying the floor test.

While resuming the floor test debate in Assembly, Speaker KR Ramesh Kumar said each member will get 10 minutes to speak on floor test debate.
"Don’t make me say this again and again," Kumar added.
Soon after the Speaker adjourned the Assembly session, Congress leaders went to the KR Ramesh office requesting to allot more time for the floor test debate.
However, reports have indicated that the Speaker did not agree to therequest and mayplanto conclude the debate by 6:00 pm and hold the floor test.
K’taka Speaker has upheld the sanctity of the whip and says it’s applicable as per 10th schedule of the Constitution.
He ruled that the Supreme Court interim order in no way protects the Rebel MLA’s if they violate the Whip.

Krishna Byre Gowda alleged that R Ashoka behind MTB Nagaraj defying Congress party orders not to leave Bengaluru.
KBG showed a video-grab of MTB Nagaraj with R Ashoka in HAL Airport before leaving for Mumbai.
To this, BJP leader Madhuswamy countered it by accusing KBG and other Congress leaders of manhandling K Sudhakar in Vidhana Soudha after the latter submitted the resignation to the Speaker, earlier in the month.

2018:The Karnataka Assembly floor test was triggered by a fractured mandate in the state Assembly elections. The Supreme Court had given BJP leader BS Yeddyurappa 24 hours to prove his majority in the Karnataka Assembly.
BJP emerged the single largest party with 104 seats but fell short of crossing the halfway mark in the 222-member Assembly. The BJP was subsequently invited by the governor to form the government.
Yeddyurappa took oath as chief minister in the face of opposition from the JD(S) and the Congress party, who claimed they had the required numbers. The coalition came about after a hung verdict in the polls.
Yeddyurappa had to prove he had the support of more than 111 members on the House floor.
The BJP, despite being the single largest party, failed to reach the majority mark. HD Kumaraswamy, as the head of the coalition government of the Congress and the JD (S), won the trust vote in the Assembly with 116 votes.
2019:The coalition government in Karnataka became shakey after 16 MLAs - 13 of the Congress and three of the JD(S) - resigned from Assembly membership. Out of the 16, 10 MLAs' resignations were found to be not in the right format. The Supreme Court on Friday asked Speaker KR Ramesh Kumar to not take any decision on resignation or disqualification. However, Karnataka Chief Minister Kumaraswamy called for a floor test on July 12, 2019, to prove the government's majority in the Assembly. The Speaker allotted a slot on July 18 for the floor test.
The Supreme Court on Tuesday reserved its order for Wednesday at 10.30 a.m. on a plea made by as many as 15 rebel MLAs from Karnataka for a direction to the Speaker to decide on their resignations.
After the entire process, if the result of votes cast by the present members is a tie, the Speaker steps in and casts his vote, thereby sealing the process.
The legislators may change party without risk of disqualification in certain circumstances. One such is when a party decides to merge with or into another party. The law allows this provided that at least two-thirds of legislators are in favour of the merger.
In this situation, neither the members who decide to merge nor the ones who stay with the original party will face disqualification. The members' votes against their party directions will still be counted as valid.
However, cross-voting and abstaining from voting while they remain present in the Assembly would attract anti-defection provisions leading to disqualification.
When a member remains absent, unless he can prove that he was absent due to a genuine emergency, it would still attract action from the anti-defection law. To escape the anti-defection law, two-third of the members of a party must refrain from the above-mentioned disqualifications, i.e the members must defect.
Article 102 of the Constitution lays down grounds for disqualification relating to the code of conduct and office of profit etc. Under Article 99 of the Constitution, no elected member of a House can take his or her seat before the oath of office is administered.
Under Article 104, they can be disqualified if they vote before taking such an oath. This means that a floor test cannot happen before the swearing-in of newly elected MLAs. Walking out of the House also calls for disqualification and becomes favourable to the opposing party.
The other major reason for disqualification is connected to either defection or switching of sides.
Anti-defection provisions were added to the Constitution as the Tenth Schedule after the 52nd Amendment. Anti-defection provisions are applied after a party has proven majority.
The speaker would conduct the floor test. His main duty is to administer the oath to the newly elected members. The Speaker also looks into the resignations of the members of the House. The Speaker's role is also crucial during a confidence vote, with the disqualification of the MLAs, given India's anti-defection law. The Speaker, by convention, can exercise his vote in the event of a tie.
Motion of no-confidence:
A motion of no confidence, alternatively the vote of no confidence or confidence motion - against the government in the state can only be introduced in the State Legislative Assembly. A State Legislative Assembly may be dissolved in a state of emergency, by the governor on request of the chief minister, or if a motion of no confidence is passed against the majority coalition.
A motion of no-confidence is usually moved by the Opposition when it feels that the ruling party or parties do not have a majority in the Assembly any longer.
Trust vote:
A trust vote can take place in an Assembly to give members the chance to convey confidence in a government. It is usually proposed by way of a motion of confidence moved by the government or brought by the Opposition. If the government lacks a majority, it would lead to its resignation.
A trust vote can be put into action when the ruling government resigns and another party stakes a claim to form the government.
In a simple floor test or even in the case of a composite floor test, the majority is sealed based on the votes of the members present. The casting of votes can be done in two ways. Voice vote: The members cast their votes orally. Division vote: Votes are cast with the use of ballots, electronic gadgets or slips. In case of a ballot, the vote cast is a secret vote.
A composite floor test is called for only when more than one party claims to form the government. This happens when the majority is not clear and the governor of the state calls for a special session to establish a majority.
The speaker will conduct the floor test to ascertain the majority. The chief minister has to move a vote of confidence and win a majority. If the confidence motion fails, the chief minister has to resign.
1)What is a floor test?
A constitutional mechanism devised to establish the executive i.e. the government's majority on the floor of the Legislative Assembly. The chief minister, appointed by the governor based on a party or coalition reaching a majority, is asked to move a vote of confidence when that majority is under question. The majority is then established or fails to be established through voting by members present in the Assembly on the designated day. If the chief minister fails to prove his majority, what follows is his resignation. A floor test can also be announced if there are differences between the parties in a coalition.

The BJP's GVL Narasimha Rao was quoted by ANI, saying, "SC in its final judgement will have to create timelines for Speakers to decide a matter be it Assembly or Parliament. If required we'll look at the need for amending the act so that Speakers can't go by their own whims and fancies."
The SC verdict could prove to be a huge setback for the ruling Congress-JDS coalition ahead of its confidence motion. The top court had said the 15 rebel MLAs can't be forced to attend the Assembly session, which means the HD Kumaraswamy regime will be short of the required number to prove majority. The coalition hoped to dangle the threat of disqualification by issuing a fresh whip. But now, the 15 MLAs will not be covered under the whip.
Leader of the Opposition BS Yeddyurappa hailed the Supreme Court ruling and said Chief Minister HD Kumaraswamy will have to resign during the confidence motion on Thursday.
"This is a very good verdict. It's a victory for democracy. The whip won't apply to the 15 MLAs who have resigned. They can't be coerced into attending the Assembly session," Yeddyurappa told reporters. "That means Kumaraswamy has lost his mandate. When he'll move the confidence motion, he must automatically resign," he said.

The Congress expressed confidence on Tuesday of winning the trust vote even as the party claimed that its rebel MLAs had been kept under “house arrest” in Mumbai by the BJP.
The Karnataka Pragnyavantha Janatha Party (KPJP) has told Assembly Speaker K R Ramesh Kumar that its legislator R Shankar, who is in the rebels camp, is barred from taking his own decision on voting during the upcoming confidence motion.
With less than 48 hours left for the coalition government to prove its majority in the Assembly,an upbeat BJP expressed confidence that the government’s collapse was imminent.
Speaking to reporters, BJP general secretary C T Ravi said that the Supreme Court’s decision regarding the rebel MLAs would have no bearing on the trust vote.
Arguments and counter-arguments in Supreme Court over the petitions filed by the rebel legislators would not help save the government, he said.
“People of the state and MLAs in the coalition government have lost faith in the government. By Thursday evening, the coalition government will be history,” he said.
Congress legislators, who have sensed the same, have started preparing for this eventuality. The party is now mentally preparing to sit in the Opposition, Ravi said.

An embattled Karnataka Chief Minister, H D Kumaraswamy, on Tuesday, questioned the Supreme Court’s authority in asking the Speaker to decide upon the resignation of rebel MLAs within a day and further restraining him from acting on disqualification petitions filed against them.

A three-judge bench presided over Chief Justice Ranjan Gogoi wrapped up hearing the arguments on questions like if the resignations of the disgruntled MLAs have to be decided by the Speaker before dealing with the disqualification proceedings.

Dhavan says political thicket doctrine meant the court will always look at the extent of jurisdiction.
"Resignations and Tenth Schedule have to be decided together. They (rebel MLAs) want court to interfere with the Speaker's power and enter political thicket. Speaker has to consider the fact that a pack of 10 and 13 are hunting to bring down the govt," Rajeev Dhavan tells Supreme Court.

SC asks Dhavan to read the reference made to arbitrariness in the Speaker's actions. But the counsel says mere reference is not good enough.
Senior Advocate Rajeev Dhavan on behalf of Karnataka Chief Minister tells Supreme Court, "every MLA who went to Mumbai wants to be Minister. It is not an individual's case but a pack of 10 MLAs.It is a matter to be decided by evening."
"There is no case under writ jurisdiction. SC passed an order in excess of its jurisdiction.This is not between the Speaker and the court but between a CM and one who wants to be CM," Dhavan says.
Singhvi on behalf of Speaker says, "You cannot take away my vested right by Article 32 petition. Disqualification is prior to resignation. Evil of defection is to be controlled. You may indicate the time limit. This is not an extreme case where you should intervene."
Karnataka Assembly Speaker K R Ramesh Kumar Tuesday said in the Supreme Court that he would decide on both disqualification and resignation of the rebel MLAs by Wednesday and requested it to modify its earlier order directing him to maintain status quo on the matter.

Singhvi says that it is factually wrong and Speaker has filed an affidavit to that effect that an appointment was not sought.
"Large parts of what he (Rohatgi) saidis factually wrong. The point is that disqualification relates back to the original act.Timing is irrelevant. The whole exercise of date and speed is wrong equation.," Sr Ad AM Singhvi for the Speaker.
"Date and race is irrelevant, Singhvi tells SC. It is not a race against time. This court is not to decide the existence or seriousness of disqualification," saidAbhishek Manu Singhvi
'See the irony, after midnight hearing last year, SC ordered floor test within 24 hours. Karnataka BJPwas asked to take the floor test by 4 pm. It was a time table set by the SC.Only immunity to the Speaker is that the court would not call in question the House proceedings. Resignation is not a matter of House proceedings. Please reiterate the order passed earlier, ask him to decide resignations," he argued.
"Order would be to decide resignations today itself, " he says while adding thatearlier, a floor test was held within 24 hrs, atthe court's instance.
"There could several reasons for an MLA to resign, reasons are irrelevant. The rule said if the MLA entered the reason in resignation, the Speaker has to erase it. Disqualification will take months to decide," Rohatgi tells SC.
Special flights from Bengaluru to Mumbai was hired by the legislators themselves and the BJP had nothing to do with it, says Rohatgi.

"The question is if there is an obligation for him to decide the disqualification before resignation," says SC.
"That I am not acting in consonance with the party", says Rohatgi.He also said that the ground for rejection is that they have not attended meetings of the party and are not disciplined towards their party and they have no real material.
"It is my case, once the resignation is moved, it must be decided in its own parameters if it is voluntary and genuine. I can understand if a gun is put on a temple, but here they have appeared before the Speaker twice.The disqualification is like mini-trial and it is a matter of evidence, it is adversarial. It can't be mixed up with resignation.Even if I am disqualified, I can contest again and become a minister after 3 months. If the resignation is accepted I can join the next government and can continue for six months," says Rohtagi.
"Our resignation must be decided. It must be deemed resignations if he does not decide. He is infringing upon my rights," says Rohatgi.
Disqualification petition and resignation are two different things, he says while citing the example of Kalaburagi BJP MP Umesh Jadhav who resignation was accepted by the Speaker after he defected from Cong to BJP before the Lok Sabha polls.Pendency of disqualification is no bar to accept resignation, he emphasized.

On the back of BJP state president BS Yeddyurappa's claim that some more legislators may resign, the Congress is mulling shifting its flock to a resort in Devanahalli on the outskirts of Bengaluru.
As the Congress-JDS coalition government faced uncertainty over its numbers, BJP's Karnataka unit chief B S Yeddyurappa Monday said he was confident of forming the government in the next four to five days.
Two rebel legislators, one each from the Congress and JD(S), failed to appear before the Karnataka Assembly Speaker K R Ramesh Kumar on Monday for a personal hearing over their resignations from the House, official sources said.
BJP issues whip to its MLAs ahead of the floor test on July 18. The Party has also directed its MLAs to vote against Karnataka CM HD Kumaraswamy's trust vote.
Ramalinga Reddy was supposed to meet the Speaker KR Ramesh in person at 4:00 pm July 15 over his resignation of MLA position. But, he won't be coming to the Vidhana Soudha today due to ill health concern.
Reddy claimed that his eyes need treatment and requested two day's time to meet the Speaker, TV reports say.
JD(S) MLA Gopalaiah (Mahalakshmi Layout) was also summoned to meet Speaker in person for the same aforementioned reason. But, since he is in Mumbai, there won't be any meeting.
15 Rebel Congress and JD(S), who are now staying Rennaisance Hotel in Mumbai have apparently decided to skip the floor test at Vidhana Soudha, Bengaluru on July 18 - TV reports say.
It can be noted that the fate of the rebel legislators' resignation will be decided in the Supreme Court on July 16. Last week, they moved the top court against the Speaker KR Ramesh for delaying to decide their resignation.
CM HD Kumaraswamy had asked the Speaker to hold floor test on Friday (19 July), to which main opposition BJP objected and requested to move the motion of confidence at the earliest.
After hearing arguments from the ruling party and the opposition, Speaker KR Ramesh has adjourned the State Assembly session till July 18 and added that the floor test will take place on the same day at 11:00 am.

BJP chief BS Yeddyurappa is holding legislature party meeting at Vidhana Soudha and is later expected to submit a proposal to the Speaker KR Ramesh to move confidence motion later today during the Monsoon session.
On Saturday (July 13), five rebel legislators --K Sudhakar, Roshan Baig, M T B Nagaraj, Muniratna and Anand Singh from Karnataka approached the Supreme Court seeking a direction to Assembly Speaker K R Ramesh Kumar to decide on their resignations.
They contended that the Speaker KR Ramesh is delaying to process the resignation and has failed in his duty.
“It is extremely pertinent to state that there were no disqualification proceedings against the said members as on the date of the resignation. Therefore, there is absolutely no ground to deny the said right of the resignation on the ground of pendency of disqualification proceedings. The said resignation cannot be invalidated by filing disqualification proceedings subsequently,” their plea states.
Supreme Court said they would hear the case of five rebel MLAs tomorrow along with the main petition which is pending before them.

After receiving resignation letters from 16 Congress-JDS MLAs on July 6, Speaker KR Ramesh had asked three leaders- Narayan Gowda, Anand Singh, and Pratapgouda Patil to meet him at 4:00 pm, 12 July.

As per Article 190-3(B) of Constitution of India, Speaker or Assembly Chairman should be convinced the resignation letter submitted by the leader is voluntary and genuine. Only then, accept it.

A bench headed by Chief Justice Ranjan Gogoi is hearing a bunch of pleas moved by the speaker and the rebel Congress and JD(S) MLAs.
The MLAs told the bench that the speaker had not taken any decision on their decision to step down, adding that he had no immunity with regard to the acceptance of the resignations.
However, the counsel appearing for the Karnataka Assembly speaker said he was constitutionally obligated to decide on a plea for disqualification of the rebel MLAs.
The hearing is underway in the top court.

However we have all the respect to the judgement of SC and we will take the SC advice seriously. Resignation of the rebel MLAs – 10 Congress and three JD(S) - and two Cabinet ministers has brought the H D Kumaraswamy-led coalition government on the verge of collapse. Though the MLAs resigned on Saturday, the Speaker decided to look into their papers on Tuesday as he was busy with other engagements.
Official sources in the Assembly secretariat said the Speaker has many options before him.
"I'm hurt by the way Congress has treated me and suspended me as I spoke bitter truth. The state leadership has failed, there is no accountability. I am not going to either Mumbai or Goa, I am in Bengaluru. I am going to resign from MLA post. They (BJP) are in touch with me," said Roshan Baig.
"Kyun nahi! Main imaan nahi badal raha. BJP is also a political party, us mein kya buri baat hai (why not! I am not changing my belief. BJP is also a political party and what is wrong in it?),"Roshan Baig on being asked if he will join Bharatiya Janata Party.

In a surprising turn of events, 14 rebel Congress-JD(S) legislators from Karnataka - who were camping in Mumbai for last three days - have moved to Goa.
The MLAs have been staying in the Sofitel Hotel in Bandra-Kurla Complex.
Meanwhile, 10 MLAs are expected to arrive in Mumbai as the political crisis deepened in Karnataka.

Dubbing the Congress's claim of a BJP hand behind the resignation of ruling alliance MLAs to destabilise the government in the state as "bogus", Joshi said, "All this is happening because the Congress has become leaderless and rather than blaming others, they should settle their house first."

The Congress on Saturday accused the BJP of trying to bring down its coalition government in Karnataka by "buying" MLAs and asserted that the new word for the 'aaya ram gaya ram' phenomenon is "MODI -- mischievously orchestrated defections in India".
The strong reaction of the party came after 13 legislators of the ruling Congress-JD(S) alliance in Karnataka submitted their resignation to the Speaker.
The ruling coalition, which has 118 members, faces the risk of losing the majority in the 224-member Assembly if the resignations are accepted.
"The new word for 'aaya ram gaya ram' is MODI -- mischievously orchestrated defections in India. The Karnataka government which is a joint government having complete majority under our democratic setup is now being sought to be pulled down by defections and resignations," Congress's chief spokesperson Randeep Surjewala told reporters here.
"MLAs are being bought in broad daylight. We deprecate the efforts of the BJP to buy over legislators, to pressurise legislators, to bring down an elected government in Karnataka," he said, asserting that the BJP has made such moves in other states in the past as well.
The 'aaya ram, gaya ram' phenomenon refers to the practice of MLAs defecting to other parties.

This is how a top Congress leader summarizes the mood in the party, even as uncertainty looms large over the Congress-JD(S) coalition after the resignation of Congress legislators Anand Singh and Ramesh Jarkiholi.
The HD Kumaraswamy-led coalition government, which has completed 13 months in office, has had a sword hanging over its head since day one. “It’s been like this every day,” Congress’ Mines & Geology Minister Rajashekhar Patil told reporters.
For the Congress leadership, however, keeping the coalition intact is inevitable, much as some of its own leaders are against it - a true dilemma, as this alliance with the JD(S) is hurting the party on one hand and the need to stay in power on the other.
The party is putting up a brave face. Notwithstanding the looming crisis, Karnataka Pradesh Congress Committee (KPCC) president Dinesh Gundu Rao left for London with family.

The BJP has 105 and will need another 13 MLAs to resign to be able to form its government. “That’s a big number of people who should resign,” a Congress minister pointed out. “And it’s not easy.”
Water Resources Minister DK Shivakumar, the Congress’ Man Friday, said Tuesday there was no need to panic. “This government will complete its full term,” he said. “It’s not that we don’t know the games being played.”
